Agreement to these terms

These Terms of Service govern your use of FreeMotorHomes.com. By visiting the site, creating an account, posting a listing, or contacting another user, you agree to be bound by them. If you do not agree with any part of these terms, do not use the site.

Please read them along with our Privacy Policy, which explains what we do with your information.

What FreeMotorHomes.com is, and what it is not

FreeMotorHomes.com is a classified listing board. It lets people advertise motor homes and trailers — free ones, and ones priced under $10,000 — and lets buyers find them and contact the seller directly.

To be completely clear about our role:

• We are not a dealer, broker, auctioneer, agent, escrow service or payment processor.
• We do not own, inspect, appraise, test, transport or store any vehicle listed on the site.
• We do not verify any seller's identity, ownership, title, lien status or legal right to sell.
• We do not negotiate, mediate or take any part in a transaction between a buyer and a seller, and we are not a party to any agreement they reach.
• Any agreement of sale is solely between the buyer and the seller. Every step of it is their own responsibility.

Who may use the site

You may use FreeMotorHomes.com only if you can enter into a binding contract where you live, and in any case you must be at least 18 years old. You must not use the site if you have been banned from it, or if doing so would break any law that applies to you. If you use the site for a business, you confirm you are authorised to accept these terms for that business.

Your account

An account is free and is only needed to post a listing. If you create one:

• Give us accurate information, and keep it up to date.
• Keep your password confidential. You are responsible for everything done through your account, whether or not you authorised it.
• Do not share your account, or create accounts to get around a suspension, a removal, or a fee.
• We may suspend or close an account that breaks these terms.

Listing rules

You are responsible for everything you post, and for the accuracy of it.

• You must own the vehicle or be authorised by its owner to sell it.
• The title, registration and ownership details you provide must be accurate and complete.
• The listing must be genuinely free or priced under $10,000. Listings outside those tiers may be removed without notice.
• Photos must be of the actual vehicle being sold.
• Describe the vehicle honestly, including known faults, damage and missing parts.
• No stolen vehicles, no vehicles you have no legal right to transfer, and nothing unlawful.
• One listing per vehicle. No duplicates, no spam, and no keyword stuffing.
• Do not publish anyone else's contact details or photos without their permission.
• We may review, edit, refuse or remove any listing at any time, for any reason, including to comply with the law or with a complaint.

How long a listing runs

Every listing runs for 45 days. The run starts on the day the listing fee is paid and the listing goes live, and it ends automatically when those 45 days are up.

• When the 45 days end, the listing is removed from the site automatically. We do not send a reminder beforehand, and the listing fee is not refunded at that point.
• You can delete your listing yourself at any time before then, from My Listings.
• If you want the vehicle advertised again afterwards, post a new listing when you are ready — that starts a new 45-day run and requires a new listing fee.

The listing fee and our no-refund policy

Publishing a listing requires a one-time listing fee of $2. The fee is charged to publish your listing — not when it sells, and not as a commission. We take no percentage and no share of the sale price.

All fees are non-refundable. The fee pays for the publishing and hosting of your listing, which we provide whether or not the listing achieves the result you hoped for. In particular, no refund will be given because:

• The vehicle does not sell, or takes longer to sell than you expected.
• Nobody contacts you, or buyers waste your time or make low offers.
• You change your mind, or sell the vehicle somewhere else.
• You made a mistake in the listing, or want to change it after publishing.
• You delete your listing, or it is removed for reaching the end of its run.
• We remove your listing or close your account because it broke these terms.
• The vehicle's condition, title, paperwork or location turns out to be a problem.

Buying and selling is between you and the other person

We provide a place to advertise and to look — nothing more.

• Buyers and sellers deal with each other directly, at their own risk.
• We do not guarantee that a listing is accurate, lawful, complete, available, safe, or that a seller has the right to sell the vehicle.
• We do not guarantee any reply, any sale, or any particular outcome.
• We do not hold money, deposits, titles or documents, and we have no control over how a transaction is carried out.
• We are not obliged to mediate or resolve any dispute between users, and we take no responsibility for one.
• Read our Buyer's Guide and Seller's Guide, meet in daylight and in public, and never send money to someone you have not met and whose paperwork you have not seen.

Rules of conduct

When you use the site, you agree not to:

• post false, misleading or fraudulent listings, or misrepresent a vehicle;
• impersonate any person or business, or claim a connection you do not have;
• use the site to scam, defraud, threaten, harass or intimidate anyone;
• scrape, harvest or collect other users' contact details or content;
• send spam, or advertise to users who did not invite it;
• use bots, crawlers, or automated tools to access the site without our written permission;
• attempt to avoid the listing fee, or interfere with the site's security, servers or operation;
• upload viruses, malware or any harmful code; or
• use the site for anything unlawful.

Content you post

Your photos and text stay yours, but we need permission to display them.

• You keep ownership of the content you post.
• You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, publish, display and distribute your content on and in connection with the site, including to promote the site.
• You confirm that you hold all the rights needed to post your content, including any photos taken by somebody else.
• We may remove any content at any time, and we do not have to keep backups. Keep your own copies of anything you care about.

Our content

The site itself — its design, layout, name, logo, text and code — belongs to us or our licensors and is protected by intellectual property law. Do not copy, modify, distribute, resell or create derivative works from the site or its content, except as the site itself allows or as we agree in writing.

Advertising and third-party links

Businesses may advertise on the site. An advertisement is not a recommendation or endorsement by us, and any dealings you have with an advertiser — including anything they sell you — are between you and them.

Links to other websites are there for convenience. We do not control those sites and we are not responsible for their content, their terms or their practices.

The site is provided "as is"

To the fullest extent permitted by law:

• The site is provided "as is" and "as available", with all faults and without warranties of any kind.
• We disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• We do not warrant that the site will be uninterrupted, secure, timely or error-free, or that any listing is accurate, lawful or genuine.
• We do not warrant any vehicle's condition, roadworthiness, safety, history, mileage, paperwork or title.
• Vehicles change hands as-is, from seller to buyer. We make no representation about any vehicle and we are not a party to its sale.

Limitation of liability

To the fullest extent permitted by law:

• FreeMotorHomes.com and the people who run it are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost data or the cost of a replacement vehicle — however caused, and whether or not we were told that such damage was possible.
• We are not liable for anything that happens between users, including a vehicle's condition, a failed or dishonest deal, a title or lien problem, a deposit that is not returned, a towing, storage or repair bill, an injury, or a scam.
• Our total liability for all claims relating to the site is limited to the greater of $100, or the total listing fees you paid us in the twelve months before the claim arose.
• Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Where that is the case, our liability is limited to the maximum the law allows, and nothing in these terms limits any liability that cannot lawfully be limited.

Indemnity

You agree to defend, indemnify and hold harmless FreeMotorHomes.com and the people who run it from any claim, loss, liability, cost or expense — including reasonable legal fees — arising out of your listings or content, your use of the site, your dealings with another user, or your breach of these terms or of any law.

Release

To the fullest extent permitted by law, you release FreeMotorHomes.com and the people who run it from any and all claims, demands and damages of every kind, known or unknown, arising out of or in any way connected with a dispute with another user of the site.

Suspension and termination

We may limit or end your access to the site.

• We may suspend, restrict or close your account, and remove any listing, at any time and with or without notice, if we believe you have broken these terms or if we think it is necessary to protect the site, other users or ourselves.
• You may stop using the site at any time, and delete your own listings from My Listings.
• The sections on the listing fee and no refunds, buying and selling between users, disclaimers, limitation of liability, indemnity, release, and governing law continue to apply after your account ends.

Governing law and disputes

These terms are governed by the laws of the state in which FreeMotorHomes.com is operated, without regard to its conflict-of-law rules.

If you have a complaint, contact us first and give us a reasonable chance to put it right. If we cannot resolve it, disputes will be handled by the courts of that state. Nothing in these terms prevents either side from bringing a claim in a small claims court where one applies.

Changes to these terms

We may update these terms at any time. When we do, the date at the top of this page changes. Continuing to use the site after that date means you accept the updated terms. If you do not agree with a change, stop using the site.

General

A few standard points that apply to the whole of these terms.

• If any part of these terms is found to be unenforceable, the rest of them stay in force.
• If we do not enforce a term, that is not a waiver of it.
• These terms, together with our Privacy Policy, are the entire agreement between you and us about the site.
• You may not transfer your rights under these terms. We may transfer ours.
